Politica de imigratie in Canada este impinsa de interese economice si de acea sponsorarea persoanelor in virsta care nu pot, in cele mai mari cazuri, intra in piata de munca a fost scoasa din prioritate. Asta inseamna ca sponsorizarea parintilor si a buniciilor poate sa dureze intre 4 ani - 7 ani de zile.

Cine poate sponsora? In general, cetateni Canadieni si residentii permanentii in Canada pos sponsora parinti si bunici. A sponsora inseamna a lua o promisiune ca sinteti responsabili financiar pentru personana sponsorata timp de 10 ani de la venirea lor in Canada. Esential, sponsorul va fi responsabil financiar de mincarea si gazda personaelor care sint sponsorate in Canada, dar nu pentru costuri medicale. In caz de parinti sau bunici sponsorului intra pe asistenta sociala in acest timp de promisiune, sponsorul devine responsabil pentru a re-imbursa statul Canadian pentru asistenta sociala platita personalor sponsorizate.

Deoarece sponsorul trebuie sa dea o promisiune financiara guvernului Canadian, este necesar ca sponsorul sa se califice financiar pentru a sponsoriza parinti si bunici. Daca sponsorul se califica financiar, exista doua posibilitati de asista parinti si bunici sa imigreze in Canada:



(1) Sponsorizare din Strainatate

Sponsorizare din strainatate este situatia cea mai comuna in care sponsorii se afla in Canada si parinti, sau bunicii lor se afla in Romania. Sponsorizarea se va face prin Bucuresti si are doua stagii:
(a) aprobarea sponsorului; si
(b) aprobarea imigrantului.

Aprobarea sponsorului se face prin Mississauga, Ontario. In acest stagiu sponsorul trimite formularele de sponsor, in care se dovedeste situatia financiara si capabilitatea de a intretine parinti, la Missisauga. Ministerul de Imigrare va evalua fisa si, daca sponsorul se va califica, va trimite notificare la ambasada din Bucuresti si de acea la sponsori ca sa poata incepe stagiul (b) al sponsorizari. Duratia de procesare la Missisauga este acum de doi ani sau mai mult.

Aprobarea parintilor sau a bunicilor ca imigranti se va face prin Bucuresti, dar formularele parintilor pot fi pregatite chiar in Canada de sponsorii. Este necesar ca parinti sa obtina certificate medicale si certificate de politie, dupa care vor trimite aceste certificate impreuna cu formularele de imigranti la Ambasada dupa Nicolae Iorga in Bucuresti. Timpul de procesare la acest nivel este intre 2 si 5 ani sau mai mult.

Ce se poate face intre timp ce fisele sponsorilor sau a parintilor merg prin sistem? In 2005 Joe Volpe, ministrul de imigratie, a anuntat o noua regulatie care relaxeaza procesarea viselor de visita pentru parintii sponsorati. In alte cuvinte, o data ce parinti sau bunici a fost sponsorati (fisa trimisa la Mississauga), sponsori pot cere vise de visita pentru ca parinti sa vina in Canada. Aceste cereri de visita se proceseaza mai usor comform cu noua politica din Ottawa.

O data ce parinti se afla in Canada, statutul lor in Canada se poate extinde de citeva ori, chiar citeodata, ani de zile pina cind fisa lor de imigratie permanenta este procesata in Bucuresti. Extinderea de visa nu este garantata si este posibil ca sa fie refuzati si ca parinti sa trebuiasca sa se reintoarca in Romania.

(2) Sponsorizare din Canada

Sponsorizare direct prin Canada se poate face printro cerere umanitariana ("Humanitarian and Compassionate"  application).  Aceasta cerere este recomandabila numai in situatiile in care parinti deja se afla in Canada si ar suferii mult daca sar reintoarca in Romania. Aceasta cerere se face prin Vegreville, Alberta, si nu necesita o sponsorizare, dar este recomandabil ca copii sa puna o sponsorizare pentru parinti linga aplicatia umanitariana. Aceste aplicatii dureaza in jur de 1 an sau mai mult.

Din pacate, ca sa reusiti o cerere umanitariana nu este sufficient ca parinti sa se afla in Canada si sa doreasca sa ramina in Canada fara sa se mai reintoarca in Romania. Calea sponsorizarii printro cerere umanitariana trebuie rezervata pentru situatiile in care circumstantele parintilor sint foarte favorabile. Situatii favorabile exista, de exemplu, in cazurin in care parintii sint atasatii de nepoti lor in Canada, ca in cazurile in care bunicii au devenit primari ingrijitori pentru copii.

De asemenea, daca parinti nu au suport financiar sau personal in Romania, sau daca nu mai au proprietate sau familie in Romania au sanse crescute sa reuseasca sa-si sponsorizeze parinti prin Canada. Din pacate, succesul unui cereri umanitariane nu este asigurat si este recomandabil ca o sponsorizare prin Canada sub categoria umanitariana sa fie rezervate pentru cazurile mai extreme.

Probleme frecvent intimpinate in sponsorizarea parintilor

Cea mai comuna problema intimpinata in sponsorizarea parintilor este inadmisibilitatea din cauza problemelor medicale. Sponsoring Parents and Grandparents for Immigration to Canada

Current immigration policies in Canada have prioritized economic and business immigration and sidelined all family based immigration. For those wishing to sponsor their parents or grandparents, they should be warned that processing times are between 4 to 7 years or more.

Who can sponsor? In general, Canadian citizens and permanent residents of Canada can sponsor their parents or grandparents. To sponsor means to give an undertaking to the Canadian government that the sponsor will be financially responsible for the sponsored persons for a duration of 10 years from their time of arrival in Canada. In other words, if the sponsored persons receive social assistance (welfare) during the 10 year undertaking, the sponsor will have to reimburse the Canadian government for all social assistance payments made to the immigrant.

Because the sponsor must give a financial undertaking in order to sponsor parents for immigration to Canada, he or she must undergo a financially eligibility test prior to sponsoring their parents. There are thus various income requirements based on the sponsor's number of family dependents and the number of persons being sponsored. For example, a single person can sponsor one parent on a salary of CDN$25,000, whereas a husband and wife with two children must have an income of CDN$46,000 per year to sponsor two parents for immigration to Canada.

If you qualify to sponsor your parents, there are two different possibilities for assisting your parents or grandparents to immigrate to Canada:

 (1)  Overseas Sponsorship

This is the most common type of sponsorship in which the sponsors are in Canada and the parents are overseas. The sponsorship will be done in two stages: (a) sponsor approval; and (b) immigrant approval.

At the first stage, the sponsor must apply to the Immigration Canada office in Mississauga, Ontario, and prove that they meet the financial requirements to sponsor their parents for immigration to Canada. If the sponsor qualifies, Immigration Canada will forward a notice to the overseas visa office responsible for the country of nationality of the parents as well send notice to the sponsor that they are approved. The processing time for this first stage is two years or more.

At the second stage, the parents must obtain medical and criminal certificates to prove that they are admissible for immigration to Canada. For ease of processing it is recommended that the sponsors in Canada (who speak English) prepare the forms necessary for the parents and that these forms be forwarded to the parents in their country of nationality for review and signing. This second stage of processing can take between 2 and 5 years or more.

What can parents do while their files are being processed by Immigration Canada? In 2005 Joe Volpe, Minister of Immigration, announced a new policy for processing visitor visas for parents who are being processed for permanent immigration to Canada. What this means is that once the sponsors have sent their sponsorship applications to Mississauga, they can request visitor visas for their parents.

Once parents are in Canada on visitor visas their stay can be extended several times, sometimes for several months or years, until their sponsorship files are fully processed. Visitor visa extensions are not always approved, and it is possible that the parents will be asked to return to their country of nationality.

 (2)  Immigration through Canada

Parents can also immigrate directly through Canada by filing a Humanitarian and Compassionate ground application. This type of application is recommended only in those situations in which the parents are already in Canada and would suffer tremendous hardship should they be asked to return to their country of nationality to be sponsored from overseas. This application must be sent to Vegreville, Alberta and does not require a sponsorship application, though it is recommended that the children in Canada file sponsorship application along with the humanitarian application. This type of application can take one year or more to be processed.

As already mentioned, in order for parents to be accepted for immigration to Canada directly through Canada their circumstances must be unusual, undeserved and excessive. If, for example, parents are financially and emotionally dependent on their children in Canada, or they have become caretakers for their grandchildren in Canada, the chances of being approved for a humanitarian application are significantly increased.

Frequent problems with parental sponsorship

The most common difficulty encountered when sponsoring parents is due to medical inadmissibilities. If parents have serious medical conditions, such as advanced cancer or heart conditions, they may not be admissible to Canada if such conditions require medical costs of more than CDN$4,000 per year.

Your family doctor can anticipate such difficulties, but only the visa officer can make the final determination of whether your parents are medically inadmissible. Unfortunately, if your parents are medically admissible at the time they apply for immigration, but 4 or 5 years later when their immigration file is finalized they have developed a medical condition, they will be deemed inadmissible for immigration to Canada.

In all cases in which parents are refused for reasons of medical inadmissibility, an appeal can be filed with the Immigration and Refugee Board or a judicial review with the Federal Court of Canada. Chances of success before the Board are realistic and even in cases in which the Board finds no errors in the visa officer's refusal, the Board may still award immigration status to the parents.
