Introduction & Overview of Quebec Court System

English text https://www.quebec.ca/ justice-et-etat-civil/systeme-judiciaire/

Français https://www.quebec.ca/ justice-et-etat-civil/systeme-judiciaire

"The different courts that make up the Québec judicial system are forums to which opposing parties can bring their conflicts in order to resolve them. The role of the various courts is to interpret the law and apply it to the cases that are submitted to them. Each court has its own jurisdiction.

"The jurisdictions of the various courts, namely the cases that a given court can hear and judge, are determined by law. Jurisdiction depends on several factors, including the nature of the case submitted to the court (civil or criminal), the geographic location, the amount in dispute, or, in certain cases, the ages of the individuals involved, as in the case of the Youth Division.

"While this text is not exhaustive, it will give you a good idea of the role of the principal courts.

  • The Municipal Court
  • The Court of Québec
    • The Civil Division
    • The Criminal and Penal Division
    • The Youth Division.
  • The Superior Court
  • The Court of Appeal
  • The Supreme Court of Canada

Small Claims Courts

"If you cannot resolve a dispute with a service provider, merchant, or skilled tradesman, a quick, economical solution is available in the form of legal action at the Small Claims Division of the Court of Québec."

"The Small Claims Division hears disputes involving sums of money as well as other cases undertaken to cancel or terminate a contract, when the object of the contract and the sum claimed do not exceed $7,000 each. This is a division of the Court of Québec where people act on their own behalf, without a lawyer"
